ALLEGED BURGLARY

RETRIAL OF ONE ACCUSED (Per United Press Association.) WELLINGTON, August 3. The retrial of Phillip Gordon Brazier on charges arising out of the breaking and entering of the Hawke’s Bay I) aimers Co-operative Stores at Dannevirke on March 21 was commenced in the Supreme Court to-day before Mr Justice Reed and a IrwMay last Brazier and George Albert Edwards were jointly charged with breaking and entering the stores and stealing tobacco and cigarettes, and, further, with receiving tobacco and cigarettes knowing them to have been dishonestly obtained. Th e jury brought in a verdict of guilty on the first count against Brazier, who was sentenced to two years’ imprisonment with bard labour. Edwards was found not guilty and discharged. Brazier appealed against the sentence, and a newtrial w-as ordered. This second hearing began to-day. when Brazier was charged with .breaking and entering the store and stealing tobacco and cigarettes valued at £Bl and, alternatively, with theft. He was further charged with the theft at Wellington ot a quantity of cigarettes and tobacco valued at £44, the property of some person or persons unknown, and, alternatively. with receiving the goods knowing them to have been dishonestly obtained. The accused, who pleaded not guilty to the charges, is not represented by counsel. Mr Macassey appeared for the Crow-n. The case will be continued to-morrow.
