(2) A miner's right may be said, in general terms, to qualify the holder to prospect for any metal or mineral on Crown lands that are open for prospecting, to take up and hold (without application to, or license from, a Warden's Court) one ordinary alluvial claim for each license, and (subject to regulations) to cut timber for his own use from any unallenatcd Crown land that is open for mining and, with the consent of tho warden and on such terms as are prescribed, to make tramways or roads for such purpose.
