CHRISTCHURCH, November 7. to a smash in the Riccarton road on October 15, when a motor cat crashed into a Post and Telegraph Department s truck and the driver of the car tLA E M Ue “V y , d , lBa T pear ed, was heard in the Magistrate’s Court to-day, when Wilhana Millner, cartage contractor (Mr F. P*-° a f« ant ). .. wa ? charged with being intoxieatcd while in charge of a motor car, was given by the driver of the P, and T. truck that the defendant's car was zig-zagging along the road and suddenly made a dive for the truck. There vas a crash'and a shriek, and when witness went to the other car and opened the door the defendant practically fell out of the car. The defendant was under the influence of liquor and was stumbling about. Another motorist who came along said that the defendant had better be taken away before tl)e police came. While they were moving the vehicle Millner disappeared.

Other witnesses stated that the defendant was staggering about and his breath smelt strongly of liquor. P°l’ ce evidence was that when Millner was interviewed he said that he had left the scene of the accident to telephone for another car. After hearing the evidence for the defence the magistrate (Mr B. C. Lewey) said that the evidence against the defendant. was conclusive and he would be convicted.

On the question of penalty Mr Sargent said that the defendant wpuld be absolutely mined if his car license were taken away. He had been driving a car for 24 years and had never previously had a conviction against him in connection with his car.

The defendant was fined £ls and costs, and his license was endorsed.
