. A. J. .Petherick, public .accountant, in evidence, said that .the Usual books of account had not been kept, and the accused admitted that lie had not kept'a cash book. The trust account in, the bank had ceased, and the credit balance Jh it was 9s 3d. So .far.'as witness could tell, the total shortage was -£364. The police gave evidence that accused had made a statement that business in land agency was not bright, and to.keep afloat he was compelled to, use! deposits Pay expenses. He. had no intention to defraud anyone, hut v kept hoping for better times,
The accused pleaded guilty, arid'was committed for s’entencej ■
