CHARGES DISMISSED

BREACH OF TRUST NOT PROVED. (Per United Press Associations) WELLINGTON, August 10. The magistrate (Mr E. Page), in a reserved judgment, dismissed the charges of stealing records and receiving electrical fittings preferred against Sidney Frederick William Vausc. The defendant was head of the gramophone department of his firm’s business and was authorised to give away for the purposes of the firm’s business such records ns he thought fit. ’To constitute theft goods must be taken without colour of right, lu regard to the electrical apparatus, the evidence showed that for many years the defendant, who w r as the only one in the firm’s employ possessing technical knowledge on the point, had made a practice, with the knowledge of his employers, of taking home and testing appliances whether of his own firm or other firms with whicli ho did business. Ho was not satisfied that the defendant’s action in receiving the goods was other than honest.
