SALE OF PROPERTY.
DEAL SUBSEQUENTLY CANCELLED. AGENT ENTITLED TO COMMISSION. (Per United Press Association.) WELLINGTON, February 10. An interesting reserved was given to clav by Mr E. Pago, S.M., in respect of a land agent’s commission. 'lho Public Trustee claimed to recover £56 10s from R. B. T. Richardson. Richardson had effected the sale of *i property in Wellington terrace. He accepted a deposit and, deducting his commission, forwarded the balance to the Public Trustee, who was administering .the estate. The purchaser, however, discovered that a material fact had not been disclosed, namely—that the Public Works Department had a ban on building within 33ft of the road centre. The deposit was returned and the sale was agreed to be off. The Pubho Trustee then sought to recover the commission from Richardson. Mr Page held that the agent did all that was required of him and was entitled to retain the commission. It was because of the failure of the plaintiff to make gone, the title that the deal failed.
