Thursday, October 20. (Before Mr H. J. Dixon, S.M.) CIVIL. Judgment for plaintiff, by default, was given in the following undefended cases: — James Jarvie (Mr Kelly) v. Adam M. William Marsh was charged, on the information of Constable Hamilton, with leaving a cart unattended in the street. The Borough Ranger gave evidence that the cart had not been very long unattended.—ln reply to the Magistrate, Constable Hamilton said that there had not been very many nrosecutions of this kind in a place like Kaitangata. So far as he knew, this was about the first. —His Worship said that in the circumstances defendant would be convicted and fined ss, without costs. DOG REGISTRATION ACT. John Balloch, borough dog tax collector (Mr Kelly), proceeded against James C. Pennell (Mr Grigor) for allegedly making a false declaration under u The Dog Registration Act, 1908,” the object being to secure a license at a reduced fee for an animal which defendant registered as a drover’s dog. The point raised by the prosecution was that as defendant was a butcher he could not register his dog as belonging to a drover. —Mr Grigor, for defendant, who had pleaded not guilty, said the declaration was not a false one, but an actual fact, as defendant, in addition to being a butcher, also possessed a farm, and often drove sheep and cattle, and was therefore quite within his rights in describing his dog as a drover’s dog.—His Worship said that when droving sheep defendant was a drover. The information was dismissed, with £1 Is solicitor’s costs against the plaintiff. There was a similar charge against Alexander Balloch, but Mr Kelly intimated that in view of the magistrate’s decision the charge would be withdrawn.
