SALE OF A BULL.
CLAIM AND COUNTERCLAIM. MAGISTRATE’S RESERVED JUDGMENT. (From Our Special Correspondent.) INVERCARGILL, December 12. Reserved judgment has been delivered by Mr G. Cruickshank, S.M., in the case in which Dr Henry Percival Pickerill (of Dunedin) proceeded against David Hopkins (farmer, Tuturau) for the sum of £2l, allegedly due as the balance of purchase money on the sale of the pedigree bull Meadows Admiral. Defendant coun-ter-claimed £2OO damages through the loss sustained owing to his cows not being successfully served and consequently not coming to profit. He bought the bull from plaintiff for £42, paying £2l in cash and givi: x a promissory note for £2l. It was for the extra sum that plaintiff entered his claim. Defendant had stated that the bull proved useless for stud purposes, for which it was bought, and had finally to be sold for £2. Defendant claimed that plaintiff gave a guarantee on the worth of the bull, but the plaintiff denied this. He stated that he merely wrote to Hopkins giving the information that to the best of his knowledge the bull was, Sound. In giving his decision, the Magistrate said that if defendant was not satisfied he should have returned the bull on receipt of the letter. Defendant could not keep the bull and go on clamouring for a guarantee which he never received. He (the Magistrate) therefore held-that no guarantee was given, and he gave judgment for plaintiff on the claim and for Dr Pickerill on the counter-claim.
