ALLEGED FRAUD.
SALE OF MOTOR CARREFUSAL TO PAY. — <% (Special to Daily Times.) CHRISTCHURCH, November 25. ' Before Mr H. A. Young. S.M., in the Magistrate’s Court to-day R. B. Owen, a tailor, of Christchurch, claimed from A. J. Dyason, company manager, of Christchurch, the sum of £125 as damages for alleged fraud, or breach of warranty, in the sale of a motor car, and tlje sum also of £lB for repairs. Plaintiff alleged that Dyason had mads false representations as to the car, and that those had constituted a breach of warranty entitling him to damages. The plaintiff found the car unsatisfactory, and he, therefore, refused to meet the promissory notes, in order to bring matters to a head. The car was bought in December, 1924, for £325 on the assumption that it was in perfect running order, and had been used for only two years, yet it was a 1920 model. It was further alleged that an undertaking by Dyason to do certain repairs had not been carried out. After lengthy evidence had been heard the case was adjourned till Monday.
