ASHBURTON APPEAL CASE.
COURT RESERVES DECISION. (Peb United Pbess Association.) WELLINGTON, July 8. Tho Appeal Court to-day reserved its decision in tho Ashburton case of Morgan v \Vri"ht, concerning the administration of an estate in that district. Mr Mvora. in reply, quoted a case to show that if a truatoe wore, alive ho would no doubt have been called although the transaction was attacked 30 years after the sale, therefore why could Douglas W right not have been called to give evidence, and why was ho not called? There was a suspicion in this case just as in the one under discussion ns regards tho sale of tho land t0 fgir Robert Stout (Chief Justice): But the facts of tho case quoted are entirely different from those in tho case now before (ho court, and I fail to see their apphea'Mr Myers; My learned friend introduced tho case, and I am trying to show it is not an authority in his favour but m ours. I submit tho fact that time was the essence of tho contract, but had nothing to do with the sale. Tho whole purchase of land is under extremely suspicious circumstances, since it is to bo noted, along with other things, that a few months afterwards Douglas Wright began to buy up the trust estate. , . , Mr Justice MacGregor: What is tho position as to Mr Nosworthy’s guarantee? Mr Grosson: It can be taken as ndmittod that from 1917 onwards Douglas Wright guaranteed Mr Nosworthy for a larsro sum of money. The court reserved its decision as above stated.
