I ordered a suit from them soma timo in February last. I ordered it by post through, posting patterns hack to them. I had seen their advertisements in the “Star.” ... I filled in a chart and posted it to them with a deposit of £2. Later I went there and asked to have the suit ready to try on on Friday night. To MR ALTERS: A tailor is a man who sells clothes. . . • We do machine work ourselves . . . and I agree that as the years go on there is more and more machine work in the suits and less and less hand work. ... If you tell me that the Scott-Service people have made 5321 suits for the year ending 31st March, and have only been called on under their guarantee on 10 occasions, 1 agree that that is a very good work. I agree that it is a good record for their trade. The following guarantee was produced:— The Scott-Service Guarantee The most liberal and comprehensive Guarantee In the world. In the event of this suit proving unsatisfactory in any respect, we undertake to: — (l) Alter it free of charge. (2) Make another free of charge. (3) Or refund your money in full. This is an unqualified guarantee, covering fit, finish and quality. It means that you must be SATISFIED, or the whole of your money will be refunded. Wc give this guarantee with confidence. COOKE, Trade Union Secretary, and tailor by trade, of Christchurch, said: With regard to my experience of the tailoring business, I worked in some of tho best shops In England and New Zealand. I was also taught by my father the factory 1 work in Bradford. My father managed tho factory there’ and in Leeds, and I have had experience in that branch. . . TO MR ALPERS: That suit (referring to Scott-Service Suit) with, say, £1 for reasonable profit, would cost in materials and labour about £7. That would bo more than twice tho amount at which Scott-Service sold it to Mr Salter . . . MR ALPERS; What do you understand by “tailorod-to-mcasure ’ ’ ? Mr Cooke: I know the real difference. • It means that a suit ip made by tailors under the method which I described to you. I understand it to mean that it is made by legitimate tailors. . . . ME ALPERS: Would you say that with eight hands on team work they would give a good anatomical fit?. 1 MR COOKE: Yes, . . . MR ALPERS: I produce to you four coats. Will you tell ns how they are made? Mr Cooke, after examining the coats, declared the one made by the Scott-Service Tailoring Company to be tailor made. (This concluded the evidence of Mr Cooke.) ADDRESSING THE COURT, MR ALPERS SAID: This case does not turn upon credibility of qvldence. Mr Salter displayed the same note of bias as the witnesses this morning. The inspirator of these prosecutions is evidently Berryman, who set a trap to catch the Scott-Service, but the Scott-Service were not to be caught, and I submit they have not been caught. . . . Tho public require a tailored-to-mea-sure suit. The average working man cannot afford to pay 14 guineas, and therefore insists on a compromise. At this point the Scott-Service Tailoring Company steps in and gives him a well-finished suit based on this principle. They sell him an excellent suit in the high rent area, but make the suit in the low rent area. ... In the place where these suits wore made the wages paid were over and above the award minimum rates, and tho proportion of men to women, one to four, was also observed so that there was no Injury to the trade. The men and women' are paid higher rates than tho TTdniTniiTn award, so there is no Injury to the .-workers. The position to-day is anomalous in the extreme. % . . I want to show tho Court how very artificial are the conditions in the tailoring trade, and they chnnot have been intended by the Arbitration Court to have been so artificially construed. If the try-on had been in their workrooms at Cashel Street instead of the shop in High Street, there would have been no offence, but because a man like Salter might find it inconvenient to come to town, the Scott-Service, In order to oblige him, allow such people occasionally to save themselves trouble by trying-on in other than the actual place of making. This constitutes the offence, but the most extraordinary part is that some firms who make ready-made suits, stock sizes, can work an ingenious swindle on the public, and never transgress the law . . . but penalises a firm like Scott-Ser-vice, who endeavours to meet, and actually is meeting a genuine public -demand for a reasonable suit at a reasonable price. . / . The words complained of in these instances are “tailored-to-measure.” It is a new phrase constructed by the Scott-Service Company, and copied and followed by their competitors all over New Zealand, and those words mean, I submit, “made by tailors and tailoresses in accordance with measurements.’. We do not use the old-fashioned phrase “tailor-made” ... Evidence ♦ of Mr. Scott Ramsay MR SCOTT RAMSAY said: I am the proprietor of 13m Scott-Service Tailoring Company. The hands were paid tailoring shop award rates—not factory rates at all, and we v were employing the required number of males in proportion to females to comply with the award. . . . With regard to the coats already produced to witnesses, and on which they have already given their opinion, the one which Mr Cooke never hesitated about declaring a “tailor-made” Bolt was made by the Scott-Service Tailoring Company. Magistrate’s Decision THE MAGISTRATE, in giving his decision, said: I do not mind saying very candidly that in cases of this sort we ought to have expert evidence of the best quality. Mr Cooke will readily understand me when I say that I do not wish to say anything derogatory, but even he will have to admit that he made mistakes in his evidence—ln regard to those coats, for Instance. The evidence of the other witnesses who gave evidence, is evidence that I cannot rely upon as evidence of experts, and I do not feel, in a case of this sort, that I ought to penalise anybody on the absolute evidence of Mr Cooke, especially when it is quite clear to the Court that mistakes have been made. ...
