Thursday, Junk 9. (Before Mr H. W. Bundle, S.M.I Drunkenness.— William Fleming Ferry was charged with drunkenness.—Subiurrector Fraser said that accused was released on bail of £l—Accused was fined the amount of his bail, ir. default 24 hours’ imprisonment. Casting Offensive Matter. —Thomas Farrell was charged with casting offensive matter in Bower Rattray street on June 4 at 5.30 p.m.—Evidence was given by Sergeant M'Enteo and a constable.—Accused was fined £S, with costs. Aggravated Assault. —John Cleary was charged with committing an aggravated assault on his wife. Sub-inspector Fraser said that accused had been before the court for an aggravated assault committed in February last. —Mr A. C. Hanlon said that it ap reared that accused since February last had given very little trouble. He was a hardworking man, and his wife did not press for a penalty. She was of opinion that he would reform, and the parties would probably take up house together again. Occasionally he overstepped the mark-—Mr B. S, Irwin, who appeared for complainant, said he had been talking with her in tho witness’ room just a few minutes previously, and sho had expressed a wish that his Worship would not deal harshly witli the. man —Tho Magistrate said that the original assault was a brutal one, and the one committed the other day was of an aggravated nature. Tho onlv fact that prevented him from dealing with the case somewhat severely was that the punishment would fall on the wife. He would take into consideration the wife’s request, and would admit accused to probation for a period of two years, with a special condition that he be prohibited during that period. Variation of Maintenance Order.—Eliv.a Bake applied for a variation of a maintn•nance order made on February 25 last against her husband, George Percival Lake, for whom Mr Hanlon appeared.—After hearing evidence of complainant, his Worship refused the application. Noxious Weeds. —John Christie, for failing to clear his property at North-East Valley of noxious weeds, was fined 10s, and costs.— Mr R. Fountain, who appeared for the department, said that the property had siuco been cleared.
