Wednesday, May 27. (Before A. Chetham Strode, Esq., R.M.) Peter Williams v. Henry Gregg.—Mr Macassey (from the office of Mr Gillies) for the plaintiff, and Mr Ward for the defendant. The summons was for £l2 10s as a quarter’s rent for a piece of land in Maclaggan street. It appeared that Captain Williams w r as acting as agent for someone else; and Mr Ward moved for a nonsuit on the ground that the plaintiff had wrongly sued.—Mr Macassey was proceeding to reply on the point, when Mr Ward objected that he was not entitled.—The Magistrate overruled the objection.—Mr \Vard would object altogether to articled clerks appearing to conduct cases. Under Jervis’s Act it was distinctly required that parties should appear in person or by their counsel or attorney. It was at least a point worthy of being considered.—The Magistrate said he had considered it. In all cases where proceeding was by information and summons it was certain that under Jervis’s Act none, but qualified solicitors could appear. But cases on the civil side were quite distinct and did not come under the provisions of the Act. There had been some misconception on the part of the public through this wide distinction not having been recognised.—Mr Ward said that on whichever side a party was the Court was a police court and ought to bo guided by the police court rales.—The Magistrate could not agree, ae had considered and settled the point some time ago.—Mr Ward; Then I may send my clerk here?— The Magistrate; Yes, in civil cases. . .
