Tho Appeal Court heard the motion of Franklin John Smith, who was convlc?rxl and sentenced to seven years' imprisonment for rape at Auckland, for a new trial on the grounds that tho verdict was grv«i against the weight of evidence. Tho court reservod its judgment. The court is hearing the case of M'Donald versus Valentine and others. This is an appeal from the decision of Mr Justice 'Sim m regard to the will of Archibald M'Donald. of Lower Hutt. It is alleged that the execution of the will had been obtained by undue influence on tho part of the present appelant (plaintiff). Application for probate of the will in solemn form wag heard by Mr Justice Sim, who against tho will propounded _bv plaintiff. Plaintiff is now appealing- a-gainst; this decision. The case is proceeding.
