HIS APPfcAL DISMISSED. <P*» UwiTSD P«MS AfISOCHTIOK.I CHRTSTCHURCH, November 7. llppo Whitfield Home, a military defaulter vvlio aehiovjd a good deal of prominence about 12 months ago, recently lodged an appeal against the inclusion of his name in the Miliary Defaulters' List, but when h'S name was called in tho Magistrate's Court this afternoon it was stated that Homo had la-ft for America about three weeks ago. Home achieved notoriety in the first place owing to tho insistence with which he claimed to be an American citizen. He gave the military authorities a greiat deal of trouble before he was finally sentenced by a district court-martial at Christchurch on November 29 _ last year to 12 months' imprisonment, with hard labour, on a charge of failins- to obey the lawful commands of his superior officer. Mr Raymond. K.C., who appeared for tho Defence Department, stated that ho had beon advised that the appellant could not be present, as'.ho had left the country. Mr M'Carthy, S.M.: " Yea, that" is correct; ho lsft with a passport issued by tho American Government." Tho Magistrate dismissed tho appeal, with costs against the appellant. ■
