ALLEGED DESERTION
-p(Feom Our Own Cokkespondent.) WELLINGTON, September 17. The Minister of Defence (Sir James Allen) informed a Post reporter this morning that inquiries were being , made into the case oi Samuel Edward Fitzgerald, who was sen tencod to 12 months' imprisonment as a, de serter by a military tribunal, which bad since been said to be illegally constituted. Befcro his arrest (in 1915) Fitzgerald volunteered, but was turned down as medicalij unfit. Ho then went to sea, and was called up in the first ballot while absent from Ne-.v Zealand. In March ho was tried by a Dxs trict Court-martial, and -was sentenced tc 1.2 months' imprisonment. His claim was that ho wanted to go into (amp, but tiati been refused by the medical authorities-. The case m referod to in tho House oJ Representatives to-night by Mr Brown. Tho t'rime Minister asked members k suspend judgment for the present Whcr the Expeditionary Forces Bill was again be fore the House the Minister of Defence would make a full explanation.
