CLAIMS THAT FAILED
A SUPREME COURT ACTION.

WELLINGTON, August 21 A bupreme Court judgment was given today in the case wherein Christina and Eva Forbes claimed £2000, Mary Sullivan £150 and Catherine Sullivan £300 from uhe Palmerston North Borough Council. The claim arose out of an accident which occurred last December. WiUiam Forbes was motoring in Fitzroy street, Palmerston. accompanied by his daughters, Christina and. Eva, and the Misses Sullivan. The car came to a gate which had been left open, and passed through and over a steep embankment. Mr Forbes was killed, and the other occupants were more or less injTarecl. The gate being open and unhghted, it was claimed that tho corporation was liable for damages. Judgment was given for the defendant corporation, the court holding, that the statute did not impose a duty on the defendant to erect a protective barrier delight the spot, or otherwise warn persons of danger that had been created by the operations of Nature in cutting away the soiL
