DISOBEYING ORDERS.

CHARGE AGAINST A FIREMAN.'

(Peh United Pbess Assocution.)

WELLINGTON, December 3. James & minings, a fireman on the steamer Tokomaru, was charged to-day with wilfully disobeying orders at Sydney on November 4. The case was brought nnder the Imperial Shipping Act, as being outside the jurisdiction of the.New inland Act. It was alleged that when the steamer was in Sydney accused, when' on watch-in the stokehold, allowed four or five fires to go out, thus rendering tie boiler liable to crack. When told to alter matters he argued the point.

Evidence was given that the boiler was damaged, and the ship plunged in darkness. When spoken to accused put coal on the ashes, which was ineffective..

The second engineer said that in all the yeaTs he had been at sea, he neverv-eaw such a state of things. N Defendant denied disobeying orders. He could have got steam up in 10 minutes if allowed to do £0.

Counsel for the defence argued that the court had no jurisdiction, as the Imperial Act of 1894 was not in force in the do-

minion. The 1 alleged offence was committed in New South Wales, which country was not Tecogndsed iii the Imperial law,

The Magistrate held that the court had ample power to deal with the case. He convicted accused, and ordered him to forfeit two days' pay and to pay court costs.
