CUSTOMS FRAUD

SYDNEY, March 24. (Received March 24, at IL3O' p.m.)

In the Higli Court to-day the Minister of Customs proceeded against Ernest Samuel Turner, carrying on business as the General Motor Company, for penalties on a charge of defrauding the Customs in connection with the importation of motor cars by means of false forms and entries.

The defendant admitted the allegations, and the plaintiff and defendant agreed upon a statement of facts, which they submitted to the court.. Hie first case covered five shipments of cars, whereon duty was underpaid to the extent of £410. The second case was against the General Motor Company and Turner, and referred to 16 shipments whereon duty was evaded to the extent of £3774.

The court convicted on both eases, and a decision as to the amount of costs and penalties will be given later.

Counsel for the Customs Department said the cases disclosed altogether offenoes involving total maximum penalties of £125,000. He suggested that the court should inflict a penalty of £12,000, which was three times the amount of tho duty evaded,

Counsel for tae defendant said the frauds began in 1907. It was a, citse where a man was too weak to resist temptation.
