AUCKLAND, March 18,

In giving the decision of the nautical inquiry regarding tlie capsizs of tiie cutter Kiwi, Mr Kettle, S.M., said that the court was of opinion that the cutter capsized because ebe was overloaded above the water line, hut until regulations were issued dealing with this class of vessel the court could do nothing more than eay that the accidenj, was caused by an excess of deck cargo. The damage done was not sntiicient to allow the court to deal with the master's certificate, but as he was responsible for the overloading he was ordered to pay the costs of the inquiry.
