Duncan (Duncan and MacGiregoij appeared for the plaintiff, who supplied potatoes and other produce for die use of defendant's men, and delivered them to the vessel while in Dunedin, for which receipts were given.— For tho defence it was contended that the goods were supplied to the order of the men themselves, and not on the order cf tlio owner. It was also contended that the produce was not,of good quality.—Alter bearing- evidence, his WoTship decided in favour of the plaintiff, holding that the goods were -put on board under instructions from those in authority on the ■vessel, and that any complaint as to qua-1% should have been made on delivery.—Judgment for balance claimed (£2 te), with £1 13s costs.
