INCURRING LIABILITIES. (Per United Press Association.) AUCKLAND, May 12. , James Walter Waller- was charged at the Polico Court with a breach of the Bankruptcy Act in contracting liabilities without, having reasonable or probable ground ot being able to pay, and with having, while an undischarged bankrupt, incurred liabilities with Archibald Bryden, obtaining credit by means of fraud. Bankrupt's solicitor said that his client would plead guilty, and asked that he bo dealt with summarily,' urging ae reasons his great age and the exceptional circumstances. Waller might not have had reasonablo grounds to believe that he could discharge his liabilities, yet he thought the equity of his property in Australia would 'help,' and he anticipated assistance from a brother who had property worth from £26,C00 to £27,000. It appeared that the accused had pleaded guilty to four out of the U charges, ami' the others had been dropped. Mr Kettle, S.M., said' that it was for him to determine whether the- charges could be withdrawn once they wero laid. It was not a matter for the police, counsel, or others to arrcmge. Accused's counsel, under the altered circumstances, withdrew the plea of guilty and tho caso stands adjourned to May 26. '
