City Council, a dwyi for compensation for the death of plaintiff's husband at the Clniatchurch Railway Station yard. Hβ Honor held that although tho notice was defective, there; were euffiuient ground? in accordance with the provisions of the aet to waive notice. The effect of his Honour's decision is that judgment has been entered for tho plaintiff for £900 damages (the jury's award), which was held subject to decision on the points of law".
