Judgment was given for tho defendant iii tlio caso Skcrrctt v. tho Encyclopaedia Company, a claim to recover one guinea paid to the company oil account of the prico of tho Otago volume. Tho plaintiff contended that if a contract existed it was void, becauso tho terms were vague and uncertain; that 'it did not comply with tho Hook Purchasers Act; and that- ho was induced to sign tho order by misrepresentation. Tho magistrate held that tho form ot' order signed, together with tho fact that a dpulicato was handed to the plaintiff, showed that the provisions of Hie Book Purchasers Act had been complied with, and tho plaintiff could not say there \va3 misrepresentation regarding tho nature of the volume -when he had never seen a copy. Counsel for the plaintiff said that probably action would bo taken in another court, as a large number were interested.
