liAFFEV V. JIAKSHALL. An appeal from the magistrate's decision convicting the appellant, John Liffcy,. of an offence under tlio licensing laws. Mr Sim appeared for appellant, and Mr J. P. M. Frasor for the respondent. The hearing of the evidence for the appollaut was resumed at 10.30 a.iu.

Burrowes S. Irwin, under cross-examination by Mr Fraser, said that ho did not take auy particular , interest in tho discussion, about the Gridiron Hotel till Magoriar. returned from his dray to tho door of tho hotel and spoke to witness again about it. W. itnesr, admitted that his remarks then were inconsistent Willi bis action in going iway. It was'when he was instructed to write the first offer that he understood he was acting for Magbrian mi as his solicitor. His professional charge for the work would probably, under ordinary circumstances, have been a, guinea. Witness had nassed signatures as bad as that on. the second offer. Ho attributed Magorian's hilarity to tho fact, that he seemed pleased with his bargain. Mr Sim: You have been.criticised, Mr Irwin, for the manner in which you conducted this business for Magorian. In whose- office j did you receive your training?

Bartlett, traveller; JauiM Cotton, horse-trainer; Peter Adamson, cabinet-makor; William Andrew Woods, traveller; William Ormiston Wood) clerk; Frederick William Line, cordial-maker; William Lane, traveller; R. Robinson, farmer; Kitty Hanrahan, housemaid at tho Gridiron; Jolm Collins, licensee ot the Gladstone Hotel; and Thomas Mercer, cabman, gavo evidenco as to Mdgorian's sobriety on September 18 and 13.

, James Samson was called to give evidence ou a, question of value, but Mr Fraser objected, and tho witness stood down. Mr Sim proceeded l to review the evidence and the magistrate's decision at about i o'clock. At 4.45.Mr Fraser replied. His Honor reserved judgment, and the court rose at 5.15.
