THE EMPLOYERS' LIABILITY

WELLINGTON, December 14.
The hearing of the case in which Kllen 'Power sued W. B. Rowntree, contractor, and1 George Smart, bricklayer, for £1000 damages for the death of her husband, was continued in the Supreme Court to-day before his Honor the Chief Justice and a jury of 12, of which Mr E. G. Lows was foreman. It was alleged that deceased died as the result of injuries caused by the falling of a piece of timber, while in the employ of defendants. Evidence was given by •workmen and experts.- ■ His Honor, in his direction to the jury; said that before it >ould find for the plaintiff widow it must be satisfied that there had been negligence on the part of either..or. both defendants. The jury; by a three-fourths majority, gave a verdict for £281 for the plaintiff under the Employers' Liability Act, which was altered to £300 by consent, and a verdict given for that amount, with costs.
