Taiaroa, a claim of £1000 damages for libel. The plaintiff is a Wellington solicitor, and the defendant a member of the Legislative Council. The statement of claim set out that plaintiff unsuccessfully contested the Southern Maori electorate at the last general election, and that the defendant actively opposed his candidature. At a Native meeting it is alleged that the defendant spoke as follows:—"Thomas Ellison's license.to practise as a solicitor has been taken aw»y by the Crown;" meaning that theplaintifl'a came had been struck ofE the roll of solicitors. A second cause of action was for similar words used at another place. The defendant, in his statement of defence, denied having actively opposed the plaintiff's candidature, or having maliciously spoken or published the words attributed to him.
