The following new regulations as to special conditions to be inserted in licenses for dams of large areas and water races of large dimensions have excited much interest, 1 ancf"are referred to ia onr leading columns this morning :— . DA3I3. Special conditions to be inserted in licenses for dams ofJarge areas, granted subject to the following reservations in favour of her Majesty the tjueen, her'successors, licensees, and assigns, and to the conditions following, that is to say -.— Reservations Beserving-(a) The full and free right for all aijd sundry, her Majesty's liege subjects who may now or at any time or times hereafter do so, lawfully to fish and to boat over /« a m i'J c of the dam witlliu described. W All n«h now or hereafter being or placed in, upon, or about the site of the said dam. (c) Ihe f..1l and free right for all and sundry fcer Majesty's liege subjects, to use the site pt the said dam, and any Crown lands immediately adjoining thereto, as a place of public recreation and resort. (<i) ihe full and free right to all the water of t•* 'ru watsrshed of the site of the said dam. (c) The full and free right of her Majesty the yueeu, her successors, licensees and assigns, and to all present or future holders of miner's rights issued pursuant to the goldticlds laws of the colony for the time being in force, to discharge water taiiing 3 I and mming debris into, along, and upon the watershed of the site of the said dam, and taroiijja >iu-h watershed on to the said tite itself, without being liable to any actions suit, or other proceeding, or to any claim j tor an injunction made at the instance of I the grantee, his executors, administrators, I ana assigns. j (/.) fherigh to grant to any person or persons I ?l u?jor bo'iies Politic or corporate, being the holders of such miner's right* as aforesaid, who shall be prepared to increase the ! storage capacity of the said dam, the right to'do all things that may be necessary to increase such storage, as well as Jb divert such a quantity of water as may be warranted by such increased storage capacity, but subject to such terms and conditions as the warden may see fit to impose but so that one of such terms and conditions shall be the liability either to pay to the grantee, his executors, administrators, and as«ign« a proportionate part of the construetioi/of such dam or such annual sum as shall amount to a fair and reasonable interer-t on the co»t of such construction. Such interest Dot to exceed £5 per centum pj'r annum by the year. J Conditions. 1. That her Majesty the Queen, her successors and assigns, may at any time resume the ownership of the said dam, upon payment merely of the actual cost ot any works of artificiSPconstruction actuully performed by the grantee, his executors adunuustni ors, and assigns, either on or in connection with the said dam, and without any i further payment of any kind whatever. Such actual cost to be fixed in case of dispute by arbi- ' tration pursuant to the provisions of "The Public I Works Act, lS9i," or any statute amendin" or ! repealing inch act for the time beiug in force. I 2. In the event of any such resumption, the grantee, his executors, adminintrators, aud assigns, sh:ill be entitled to no compensation whatever in respect of any purely natural advantages of which he or they may get the benefit by reason of the within grant. 3. That if the grantee, his executors, adminis- ! tratoiv, and assigns shall at any time or times hereafter sell, let, or lease, or otherwise dispose of, all or any of the water stored in the site of the said dam to any other person or persons, or body or bodies politic or corporate, for use by such pers m or persons, or body ov bodies politic or corporate, for all or any of the purposes mentioned in section ]04 of •' The Mining Act, 1891," the price per Government head per week at which such water shall be sold or otherwise disposed of, and the rental per annum at and the terms on which such dam and water, and any races to be hereafter constructed to carry such water, shall be let or leased, shall he tix»d by the warden or w-trden.s for the time being exercising jurisdiction in the mining district in which such dam and water races may be situate; and such ' warden or wardens shall have further power from ! time to time to review, alter, and vary the j said price and rev al, as well as the said terms I and conditions, cither by higheriug or lowering ■ such price or rental, or iy varying such terras ' aud conditions, or by making any order of review, j alteration, or variation, either of general or par- I ticular application, and this notwithstanding I anything cmtiiuedor implied in any lease, agreement; of letting or selling, or.any other contract relating to the saiddams, water and water races which may at any time or times be entered into between the grau'ee, his executors, administrators, and assigns, and any other person or persons whomsoever, or body or bodies politic or corporate whatsoever, but so nevertheless that such warden shall not exercise the power of reviewing, altering, or varying iv this paragraph contained andi reserved, either generally or in reference to any particular price or rentalfoftener than once iv every three \ ears. 4. In fixing any price or rental, or any terms or conditions cither orignally or by way of review, alteration, or variance, the wmden i>hnll be guided by what would be a fair value per week or ;>er annum based on a comparison between the capital invested by the licensee on or in connection with the said water race and the dams uned iv connection therewith, and the value of thy return, or the probable value of any returns, from any ground proposed to be worked, having regard also to the hazardous and uncertain nature of the return from rapital invested in mining operations. 5.
