CIVIL SITTINGS. Wednesday, July 3. (Before his Honor Mr Justice Williams,) WINMILL AND OTHERS V. GALLIE. A suit to test the validity of the will of the late John Gallic.
Mr J. F. M. Fraser appeared on behalf of the plaintiffs, ana Mr F. B, Chapman on behalf of the defendant. The case was resumed at 11 a.m. Mr Chapman, continuing his address to the court, reviewed at considerable length the evidence of the witnesses called on behalf of the plaintiffs. Alluding to the evidence of Mrs Butcher, he submitted that it was extremely exaggerated, and, at the best, open to this observation that though she was an intelligent women she could not understand what Gallic said. He also proceeded to comment upon an occurrence whiob, he said, took place in the course of Mrs Butcher's examination, the witness beckoning to Mr Fraser and saying, " You never asked me how be dressed." Mr Fraser : I really must interrupt my learned friend. Thjs is new to me, and it has not been mentioned before. I ask my learned friend why ha did not mention it before and call his Honor's attention to it before ? Mr Chapman: I will stake my existence; I have it in my notes taken at the time. Mr Fraser: I say then that you should have called his Honor's attention to it. Mr Chapman: I take n different view from my learned friend. Ido not care to make several speeches. : Mr Fraser: Then I challengo the statemont aud deny it. Mr Chapman : I shall produce it. It is in my notes. Mr Fraser: Then I say my learned friend has misunderstood the witness. Mr Chapman: I make the assertion, your Honor. .' ' J Mr Fraser: My learned friend has no right to do that. His Honor: If there is a dispute about it— and I haven't it in my notes—l cannot settle the dispute.
