Tjicbsdav, Septkjiuhb 20. (Doforo his Honor Judge AVnrd.) JOSEPH HAfXINiN V. JOHN ARTHCH BUBNSIDE. Claim £200, damages against the architect for a building iv St. Andrew streot, it being alleged that ho had improperly allowed progress certificates to be given to the contractor entitling him to progress payments, the work being faulty. Mr Fitchett appeared for the plaintiff, and Mr Solomon for the defendant. After hearing tho ovidenc^, hia Honor nonsuited the plaintiff, with costs (£ls lie), on the ground that the matters in dispute had been already referred to arbitration by the parties, and thereforo the plaintiff was-precluded by tho award of the arbitrators from suing for damages. - "■"= '
