Mr Fitchett appeared for the plaintiff, and Mr Solomon for the defendant. After hearing tho ovidenc^, hia Honor nonsuited the plaintiff, with costs (£ls lie), on the ground that the matters in dispute had been already referred to arbitration by the parties, and thereforo the plaintiff was-precluded by tho award of the arbitrators from suing for damages. - "■"= '
