DISTRICT COURT.
Friday, 4th September, (Before His Honour Judge Bathgate.)
H. S. Fish v. Gray and Drummond.— - This was a suit for the recovery of £156 17a 9d for work done. This case was heard on Tuesday last, and His Honour now gave judgment for £55 4s ancl costs, without prejudice against plaintiff" suing Messrs Wood and Steinau for the balance of the claim made.
Franz Siedeberg v. Norman Wood. — This was an action to recover £175 12s 8d for supply of building materials, and balance of moneys due on Messrs Jolly and Field's contracts. The original claim was £641 10s 6d, and payment of £465 17s was allowed. Counsel said the claim would be reduced £60 or £70, which was not mentioned in the particulars, as defendant had refused to put in his set-off so as to allow a settlement to be come to. Mr. Stout appeared for plaintiff, and Mr M'Keay for defendant. The defence was that plaintiff had refused to complete the contracts mentioned, aud was therefore not liable to the amount sued for. The case occupied the whole day, and will be continued on Tuesday.
