SAKE OK TOVN LANDS. All town lands, except as otherwise provided, shall be sold by auction, and the upset price of the allotments shall be fixed by the Board. In tho case of sections, however, which, having been put: up for sale, have either been withdrawn or have not been sold, or which, having been sold, the purchasers have failed to complete their purchases, the Board maysell such sections otherwise than byauction.

In special cases, where persons being in duly authorised temporary occupation o£ town lands shall apply to" be allowed to purchase such lands, the Board may, witlk the approval of the Superintendent an^t Provincial Council, sell town land, except land within the limits of the towna ©It Dunedin and Port Chalmers, without exposing the same to auction.

Notice shall be given of any intended auction of town lands through the medium of the Provincial Gazette, or a newspaper published in the Province, not more than three months, nor leas than one month, before such auction shall taic place. .- ; No town land shall be sold by auction unless previously snrveyed. The land shall be offered for sale by auction by some person to be appointed. for that purpose by the Board, who, if ara officer of the Board, ahall not be required to take out an auctioneer's license. The purchaser shall pity one-tenth part of the purchase money at the time of sale, and the remaining nine-tenths shall be paid within one month of the date of sale, otherwise the deposit money shallbe for*foiled, and the sale be null and void. The upset price of rural lands shall be twenty shillings per acre ; and in the event of two or more Applications for the •same land being made on the name day such land sihall bo put up at auction, the •npstofc price of which shall be twenty shillings per acre. Land which shall have remained open for selection for woven yearn may, with the sanction of the Superintendent and Provincial Council, be offered for sale by auction at the upset price of ten shillings per acre. The Governor in Council may, upon -the recommendation of the Superintendent and tho Provincial Council, increase the price at which the waste lands shall be offered for sale, cither by selection or auction. The application of any person-desirous of purchasing rural land shall be accompanied by a deposit of ten per cent, upon the upset price, and the decision of th« Board upon such application shall, in the cuio of surveyed land, be given within six days after tho receipt of the application at the Land Oftiee in Dune-din, if there be no more than one applicant for the land. In the case of unsurveyed land, however, the decision of the Board shall be given within six months after the receipt of the application. Any applicant refusing to complete his purchase Khali forfeit the deposit he paid. Any application may, at the option of tho applicant, be enclosed in a wealed cover, which Bhall not bo opened till after the oflico hours on the day it is made. No application for a lens quantity than fifty acres of rural land shall, except- as otherwise provided, be granted by the Board. Provided always that the Board may divide any of the Waste Lands into blocks and sections of any size, and offer the same for sale, and may also permit owners of land desirous of making an addition to lands already purchased, to apply for and purchase adjoining lands of irregular shape and of small extent, if such purchase shall not unduly interfere with tho advantageous division of adjoining land into convenient allotments. The purchaser of unsurveyed land shall, upon payment of the purchase money, receive an occupation license, and as soon thereafter as conveniently may be, the land shall bo surveyed by the district surveyor. The expense of the survey shall be borne by the purchaser, who shall at the time of the purchase deposit the estimated cost of such survey. Notwithstanding that the Board may have received an application for unsurveyed land, the Board may, should they deem it prejudicial to the public interest to grant the application, refuse to grant the application, and may return the deposit money. The purchaser of surveyed land shall ■complete his purchase within ton days after his being declared the purchaser thereof ; and the purchaser of unsurveyed land shall complete his purchase within fourteen days after a notification shall have been published •in the Provincial Gazette, and sent by post to tho applicant, that the applicant has been declared the purchaser. And if, in either case, the purchase money is not paid at tho time fixed, such application shall be deemed withdrawn and cancelled, and shall thereupon become void.
