A LATE KAIKOURA, RESIDENT v AWARDED £*3500. DAMAGES. THE SEQUEL. (From Our Own Correspondent.) London, July 22. The: full particulars of-the above action werer'given .in my last letter. _ # a settlement under which provision wa3 made for the plaintiff, the action was this week brought to an end, m whicli Mrs Charlotte Halse-Francis, 'oi _ Elmexove, Worthing, and sometime or Kai- ! koura, sued Mi- James "Young, of Upper Clapton road, and Mr John bnell, of Capel road, Forest-gate, the executors of the late Mrs Maria_ Ann Francis, who resided at West Norwood, tor damage? for breach of an alleged contract oil the part of the .deceased lady to provide for her maintenance. I lie contract was denied. Mrs Halse-Francis's case was tlu.t after the" death of her husband, tiie late Dr Halse-Francis, who was uhe adopted son of Mrs Maria Francis, she returned to England at tne request oc that lady, who promised to provide ror her It was alleged by the plaintiff that, after an illness which made necessary her removal from the house at West Norwood, Mrs Marie Francis refused to take her back. The latter ladv died at the age of 83, leaving an estate of about £25,000. . ; On, the conclusion of the hearing ot the action on Tuesday week, the special jury found that there had been a contract, and that it had been biokcn, and awarded Mrs Halse-Francis. £3500 damages." Judgment was not cntfuod then pending argument on the findings of the jury. On the case now being called,. counsel announced that a settlement had been arrived at," provision being made for. the plaintiff. His Lordship expressed the view that' the proper course had been adopted.
