Captain Xaylor. of the Penguin, has appealed against the Court's finding, on the ground that it was not proved that the casualty was due to his negligence or default, or that under the circumstances shelter should have been sought or the vessel's head put to sea : that it was not proved that the master was guilty of a breach of the rules for preventing -collision at sea, or that soundings should have been take:; : that there was no evidence to show that the steamer did not strike an uncharted rock or wreckage, and ceneraliy there was no evidence warranting the Court in suspending the master's certificate.
