The appeal is from (v decision of Mr Justice Denniaton, and the question is whether, on the construction of the programme of the First Challenge Stakes. by the Canterbury Jockey Club, of which respondent is treasurer, appelant, as owner of Loyalty, is entitled to any surplus and forfeits over and above 2009 sovs, lesa amount payable cot of the stake to others- Mr Justice Denniston gave judgment for the Jockey Club, and Mr O'Brien appeals.
