The Whitaker-Hutchison Case.

In the Appeal Court this afternoon, before Judges Williams, Denniston, and Connolly, the case Whitaker v. Hutchison was heard. This was an appeal from the judgment of the Chief Justice refusing to strike out a paragraph in the defence in this action, charging Sir 11. Atkinson and Mr Mitchelson, members of the late Ministry, with being indebted to the Bank of New Zealand, and with having on that account confederated and collusively acted with the plaintiff, Sir F. Whitaker, their colleague in the Ministry, in assisting the Bank of New Zealand in its financial difficulties, to the prejudice of the taxpayers of the colony. Mr Bell appeared for the appellant, Sir F. Whitaker, and the respondent, Mr Hutchison, appeared in person. The Court adjourned at the conclusion of Mr Bell's argument.
