S:p"enbe", she not being a du'y licensed person. The defendant pleaded not guilty. Alex. Clarke s.»id his duties took him to the defendant's homo frequently f>r orders. He had never been asked to ■hoot, nor did he ev<r do bp. He had not given Mrs Lv*son 5i for drink on the 21it, and for fuliy a fortnight about tba' time he hid not tesn her. He would not a*rar he had n»t given her two hifcrowns, bnt If he had done so it would be as change in payment of goods. He did not remember -eeing any drink about the d'sc« on the 21st, acd he would aweir he hid never shouted. Oharlts Limb said on the forenoon of the 21st September the last witness cime to the difendant's house ana asked for orders. These were given by Mis Liwson, Bisay B-\rrett also ordering some goods. Barrett ssid Clarke should have the order ag-.in for beer if he wonld shout. Two hilc-crowns were then handed to Mrs Liwson, acd d-itks brcujht in for thiee prosen'. Sirab Cjndjn swore that she saw Mr CUrke at the dtfendanl'd houao cn the 21it. He wis thera almost daily, except Sundays. He was told th.it unless ho shouted he would get no more «rder3 fjr beer. Mr Clarke then handed Mrs Li*son 5 1, and five gliasea of b- er and one of whisky were brought in. This was all tho evidence called by tho prosecution. Ia reply to Mr Harvey, his Worship sild there was a cate to answer. Tue defendant ssid she did not see Mr Ctaike on tho 21-st September, nor did she supply any liquor to him. In roply to Sergt. O'Grady, witness ssid she never received any money from Mc Crarke for driuk. Tho i videnca given by Sirah Condon, thil beer a-.-d whisky were brought let) tho kitchen on that day wbs nntroe. Bessie Birrott swore that Mr Clarke had never paid for any drink in Mrs Li*son's house. Ac lie ?ime Mr Ciarko was ia the house the m»u Limb was a ray down the town. She did not bring in any tesr or drink at the time Mr C arke wee there, nor had he ever shouted in the p'ac >. Margaret Martin swore that she did net »3e Mr Cl>ike in the house of Mis Lin son on the 21st, though she was in the house several times. His Worship di-mi«sed the cis?, and Instructed Serge: nt O'Grady to prosecnte Charles Lima and Strah for w.lfal and c irrupt peijury.
