MAGISTRATE'S COURT.

THIS DAY. [Before T. \V. Parker, Esq., R.M.] STRAY CATTLE. For allowing cattle to wander within the limits of the town, the following fines were inflicted John Middleditch, one cow with tether rope, 10s. ; Patrick M'Cusker, two cows, 12s. 6d ; Robert Harney, one horse, ss. ; John Hood, two cows, 10s. ; E. Smart, one cow, ss. ; Malcolm M'lvor, one cow with tether rope, 10s. ; John Murray, one cow, ss. ; Gavin Paterson, three cows with tether ropes, 10s. each cow. INTERPLEADER SUMMONS. Steward a>d Co. v. M'Clure.—This was a case calling on defendant to support a claim made by him to all the goods and chattels of H. Cowley and Co., taken in execution under process issued at the suit of plaintiffs under judgment obtained against H. Cowley and Co. for the sum of £IS 10s. Gd. Mr. Hislop appeared for plaintiffs, and Mr. Balmer for defendant.

Sir. Hislop objected to the claim on the ground that M'Clure had not lodged the particulars of his claim in the Court four days before the hearing of the case. Mr. Balnier said he was not aware of a case in point where the objection raised by counsel had been upheld. The Magistrate was of opinion that the original plaintiffs should have had an opportunity to inspect the claim set forth previous to the hearing of the case. When a claim is set up, if of a bona fide character, could be no objection to the plaintiffs inspecting it. If the claim were a legitimate one, an adjournment to give p l aintiffs the satisfaction sought could not prejudice it, and therefore the case -would be adjourned until to-morrow morning.
