I regret that by seme inadvertence a copy of the following telegram sent by me to the Secretary of State for the Colonies, was not forwarded to yottr Excellency, as intended by mail :—' Dnnvdtti, October 6. The Right Hon. the Secretary of State for the Colonies, —Urgent. The Abolition of Provinces Act, passed last Session of the General Assembly, being forced into operation, notwithstanding the strenuous opposition of the people of Otago, constituting about one-third of the population of the Colony, I ant advised the said Act forced on in Cap. 02, of 32 \ ie., is nil fit 1 have the i onottr to suggest that the said Act be referred t« to»r Majesty's Attorney-General, with a view of disallowance if void. A deep feeling of wrong pervades the Province. The Provincial Executive is pressed to convene the Provincial Council, and assert the political rights conferred on it by the Constitution Act.'—J Ask M,irAj»»KEW, Superintendent of Otago.' In the ease, Jones and Ware remrj Brogden, the Judge decided virtually for the defendant, but held that the plaintiffs were entitted to an extension of time, when additions and alterations were made by the defendant's orders.
