Mr. Kislop. prose-silted, and Mr. O'Meagher defended the prisoner. Mr. Hislop stated the facts of the case.Matthew Grant, sworn, deposed : liemenibered the 13th April last. Saw prisoner ih' bar of the Alliance Hotel, at <> p.m, that day. Mrs. Grgoit earns to me with a cheque for £l2, ami asked if I would cash it. I then inquired who the money was for. 'Subsequently cashed the cheque for the prisoner. Took it to the Bank 011 the ] oth, when it was dishonoured, and afterwards handed it to Sergeant Carroll. Did not observe any marks on the back of the cheque before going to the Bank. Cross-examined: Presented the cheque during bank hours on the lath itlfc.; paid it i i to my accG'.mtj and was told there wjre no funds. Hoard had left Oamaru tho day before I presented the cheque. Paid the prisoner in notes. Fanny Grant, wife of the previous witness, gave corroborative evidence. John Locke, Manager of the National Bank, was then called, and gave evidence as to the state of the j>risoner's account with the Bank on thy IS'th and-15th lilt. A credit balance o: £8 3j. od. existed on the 12fch April, and 0:1 the J5 th a cheque for £5 was paid, leaving the balance at +'3 3s. 3d. The cheque produced was presented for payment 011 Saturday, the loth April, and was dishonoured. The acc mat was closed on the same day. [Left Sitting.]
