No Murder Charge

Garnet Wolseley McMinn was not called upon to face a jury on < the charge of murder preferred against him following the death of Robert Cecil Thelwall, who died . from a 'fractured skull sustained by a fall after— it was alleged — being struck by McM inn. ; , THE evidence m the lower court pro-. •*■ ceedings, as reported m "N.Z.; Truth," showed that Thelwall — who; had had a good deal of liquor— attack-' ed McMinn, with whom he had been on friendly terms for a number' of years, and without any provocation struck him several times. : Finally McMinn retaliated and struck one blow. Thelwall fell back over the kerb and sustained injuries from which he subsequently died. , McMinn was scheduled to face his trial at the Gisborne Supreme Court last week, but Mr. Justice Ostler told the grand' jury m the plainest possible terms that .the charge should not be allowed to ' proceed and it was duly thrown out. '
