When Eugene Patrick Cooney was charged with assaulting a Hindoo, Budhia Gopal, who keeps a fruit shop, Senior Sergeant Ed- . • wards related that the accused, who had been drinking, sat down on a box m the shop and refused to leave. The Hindoo didn't want him, as Ihe was spoiling custom by his ' presence, and he remonstrated with the Irishman. But the latter said he wanted to buy the shop. . Budhia was not willing to sell at the moment and .this seems to have annoyed his visitor. Cooney . finally struggled with his unwilling host, whose clothes were damaged. Magistrate Hunt imposed a fine of £2 and £.1 for damage to Bud* hia's clothes, or seven days. Mr. Snedden , (for Cooney) started to make a request to the Bench which made some mention of suppression. "I know what you.'re going to ask— well, it's useless; I'm not going to do it," broke m the Magistrate sharply. Counsel sat down. ■ i I
