Magistrate McCarthy's Conviction * Reversed. Mr. Justice Chapman, on Thursday last, m the Supreme Court, Wellington, heard an appeal by Joseph Nathan and Co. against the decision of Magistrate McCarthy, convicting them of the Bale of short-weight butter m January last to William Campbell and Co. The facts elucidated when the case was heard showed that Campbell and Co. had purchased 48 lbs. of Defiance butter from Nathan and Co., and when the Health Inspector purchased a packet of the butter it was found on weighing to be five drachms short^yeight to the pound. Tests showed that this loss could not have been caused by evaporation, and the defence was that it was due to . A TOO CLOSE ADJUSTMENT OF THE WIRES m defendants' cutting machine. His Honor held that though a probable case had been made out, it was not of such a conclusive character as It should be m a matter of such Importance, and upheld the appeal.
