Sir,— ln re the "Amorous Atholwoods" and your report, m last issue of a recent ca.?e m Melbourne, a witness, T. Dyei (CiUlcd to disprove the stupid statement that Barry Marschell was dead), stated "that two years ago last Easter 1 he met Barry Marschell m Auckland. He (Barry Marschell) was then 'livinc- with' a woman whose stage name was Irene Carlyle." As Mr Dyer was giving' evi^ dence m a Court of Law. Justice protects him from an action for slander, and as every married woman "lives" with her husband, Mr Dyer, whoever he is, has kept just over the fence m so far as a prosecution for direct perjury is concerned— still (the innuendo is there all the same. The witness evidently hadn't the faintest shadow of a slender conception of what he was talking about, for it is very generally known here that our client, the lady referred to, was married so Barry Marschell at Knox Church, Dunedin,' on the 31st March, 18&ti, by the Rev. Mr Hewitson, who is still living at the same church. The register o! the marriage may be seen there or at our office, where a copy has been deposited. As Mrs Marschell, m company with her husband, has, during the past twelve years, played m every city, town and township m New Zealand, and is consequently particularly well known, such a statement aDpearing m a newspaper with the largest circulation m the Dominion, is calculated to do her harm.
