WHARF LABOURED INJURED “A CASE OF NERVES, NOT NEURASTHENIA” CLAIM FOR COMPENSATION The Arbitration Court yesterday considered the claim for compensation entered by R. W M. Tier (Mr O. C.Mnzengarb), against the Commonwealth and Dominion Line as a result of in j uries received while in the company’s employ. When the plaintiff took proceedings in March list, the shipping company was found liable, and the plaintiff was directed to undergo an operation to his knee. The case was adjourned from June till such time as something definite could be established in regard to Tier’s disability. In evidence, plaintiff stated that he was still receiving treatment at the hospital. Medical evidence was tendered to the effect that the plaintiff’s nerves weie affected as a result of the accident, and that he was not fit for any work. It would be from four to six months before he could return to light wotlc. Ono witness said he could not be certain if the plaintiff would ever be fit for wharf work. After hearing further medical evidence as to the successful nature of an operation performed on the plaintiff’s knee, His Honour, Mr Justice Frazer, intimated that the court proposed to deal with the case purely us a nerve and not a neurasthenic case. The plaintiff was awarded one month’s compensation at the present rate of compensation, and two months’ half compensation, which would enable him to get back to a condition to allow him to again undertake heavy work. Costs amounting to £l2 12s were allowed against the defendant company, while three doctors engaged in the case were awarded expenses amounting to £5 each.

In reply to submissions made by Mr Mnzengarb, His Honour pointed out that the court had no jurisdiction in respect to the plaintiff’s hospital expenses.
