PRISONER’S APPEAL

CONVICTION TO STAND. The Appeal Court decided yesterday tlliat the conviction of Thomas James Davenport, a prisoner who had been convicted at Auckland of an indecent assault towards a little girl, should stand. The Chief Justice (Sir Robert Stout), Mr Justice Sim, Mr Justice Stringer, and Air Justice Hosking all agreed that the conviction must stand and be affirmed. The prisoner’s request lor a new trial was not granted. Mr W. C. Alaogregor, K.C., the Solicitor-General, appeared for the Crown, and Air J. J. Sullivan, of Auckland, for Davenport.
