“EXTREMELY BALD”
PRESENTATION OF. A CASE. FOR THE APPEAL COURT. Tho Appeal Court yesterday dismiss ed the appeal of Arthur Oleve against Alfred James Coleman, respondent, the Chief Justice (Sir Robert Stout) stating that both parties were to blame for the manner in which the rase had been presented Jo the court, [n his opinion the appeal should be lismissed and each party left to pay ;heir own costs. Mr Justice Sim, Mr Justice Hosking, and Mr Justice Adams all agreed that the appeal should be dismissed. The learned judge expressed the opinion that the action had been submitted for decision in the court below, and came before the Appeal Court in an “extremely bald fashion.” In order to ’determine the agreement between tho parties they were asked to construe it »nd to draw inferences from it without any evidence of the circumstances in which It was made. Tile case, an Auckland one dealt with certain land transactions, and the determination of an annuity, as well lx other mattere.
