REGULATION DECLARED ULTRA VERBS. THE CLOSE SEASON. .Per Press Association. IN VERCARGILL, November 2. Mr G. Oruickshank, S.M., held, in cases under the Animals’ Protection Act to-day, relating to being in illegal possession of opossum skins, that regulation 13 was ultra vires, in that the penalty was unlimited. It was the first instance he had ever seen of an unlimited penalty in a by-law or statute. The regulation being invalid meant that there was no penalty for the offence of being found in possession of skins in the dose season. The information was dismissed.
