“FOR BOOTS DELIVERED”
NEW PLYMOUTH IMPORTER SUED CLAIM FOR £177. Before Mr E. Page, S.M., at the Magistrate's Court yesterday, Charles J. Ward, Ltd., proceeded against Roy J. Deare, boot importer, of New Plymouth, for £177 13s, being the agreed price of one hundred and fourteen pairs of boots ordered by the defendant from the plaintiff company an October 27th, 1920, and duly delivered to defendant. Mr A. W. Blair appeared for the plaintiff and Mr H. Kennedy for the defendant.
For the defendant, it woe contended that the delivery was not in the terms of the contract. The boots should hare been to hand by November 20th, and as they had not arrived by the 24th, defendant had wired cancelling the goods, which he required immediately. The goods had come in on a falling market, and defendant had wanted to be quit of them by Christmas, and their late arrival would seriously handicap, him in this direction. The magistrate reserved his derision.
