OUT OF HARMONY

THE HAMILTON BAND DISPUTE. His Honour Sir John Salmond has given judgment at the Supremo Court in the Hamilton Band case. This was an action taken by a number of members who had seceded from tho Hamilton Band, an incorporated body which had taken tha title of the band of the 16th Waikato .Regiment. Plaintiffs sought to recover possession of tho common seal and books of the band, on tho ground that they were a majority of tho newly-balloted members, and therefore constituted tho Hamilton Band. Mr R. M. MoVeagh appeared for the plaintiffs, and Mr J. R. Reed, K. 0., for the defence. His Honour held that when tho members seceded they relinouished their membership of tho band, and that there was only one band existing at that time. Their resignations were not from the regiment only, hut from the band.

Judgment was therefore given for defendants, with costs.
